Pinkie, regardless of whether its the truth or not, the person who owns the account is responsible for it. So even if it was his brother, the punishment stands because it's his account and he allowed his brother to use it.

I agree with Hal, It's always the same excuse with most ppl who got silenced. It's always their brother/sister/girlfriend/boyfriend/cousin/friend who got them silenced. 
