I'm gonna go with all of them being the correct answer including the waiter and plausible suicide. This is most likely an exercise in analyzing ones train of thought and reasoning.

 

I mean, you're also not supposed to kill people, but the killer did, so I doubt they'd have any problems about going into the wrong bathroom

 

The answer is 3. This riddle expects you to make assumptions about gender. Like someone already stated, there is visually only one representation of what can be most agreeably immediately perceived by most people to be a drawing of a female in this depiction. The assumption is that only a female can enter a women's restroom without causing a noticeable disturbance upon entry, or alarming another woman while being inside of the women's restroom. Therefore, she was able to commit the murder and return to her seat without drawing much attention to herself.
